1 <br />in real property described in Plaintiff's Complaint on file <br />herein and described in Exhibit A attached hereto and have <br />2 <br />waived Findings of Fact, Conclusions of Law and Notice of Entry <br />3 <br />of Judgment, <br />4 <br />NOW, THEREFORE, IT IS HEREBY ORDERED, ADJUDGED AND <br />5 <br />DECREED that: <br />6 <br />1. Just compensation to be paid by Plaintiff for <br />7 <br />the acquisition of said property to Defendants ROBERT E. <br />8 <br />FAUSSNER, Trustee of the Robert E. Faussner Trust and BURTON M. <br />9 <br />SAFT is the sum of ELEVEN THOUSAND DOLLARS ($11,000.00). In <br />10 <br />addition, Plaintiff shall pay to said Defendants the sum of <br />11 <br />$114.00 in costs. <br />12 <br />2. Plaintiff shall deposit the sums specified in <br />13 <br />paragraph 1 above with Placer Title Insurance Company of San <br />14 <br />Leandro, California. Plaintiff shall instruct Placer Title <br />15 <br />Insurance Company to pay the said sum to "ROBERT E. FAUSSNER, <br />16 <br />Trustee of the Robert E. Faussner Trust, BURTON M. SAFT and <br />17 <br />Paul N. McCloskey, Jr.," their attorney of record herein, upon <br />18 <br />recordation of the Final Order of Condemnation. <br />19 <br />3. The payment of the sum set forth in paragraph 1 <br />20 <br />shall be in full payment for the real property or interest in <br />21 <br />real property hereinabove described and for any and all damage <br />22 <br />of every kind and nature accruing by reason of the acquisition <br />23 <br />of said property and the construction and maintenance thereon <br />24 <br />of the public improvement as proposed by Plaintiff, including <br />25 <br />26 <br />severance damages. <br />4.
