or handling of products or substances, such as <br />gasoline, diesel fuel and cleaning solvents, <br />which, if not stored, processed and handled <br />properly, can cause contamination of soil and <br />groundwater. <br />Therefore, within the project area, the <br />agency may take any actions which it <br />determines are necessary and which are <br />consistent with applicable state and federal <br />laws to remedy or remove hazardous waste <br />from property in said area in accordance with <br />provisions in the Community Redevelopment <br />Law. (Plaza 2 redev. plan § 4(J), 1988) <br />1.28.110 Railroad facilities. <br />The Southern Pacific and Union (Western) <br />Pacific railroads have operating and non - <br />operating rights -of -way within the project area <br />westerly of San Leandro Boulevard. Railroad <br />facilities located within such rights -of -way <br />include, but are not limited to, above -ground <br />private and commercial (Western Union) <br />communication lines, track systems, including <br />spur tracks, crossing signals and appurtenant <br />railroad -related equipment. <br />The Union Pacific Railroad maintains and <br />operates a shipping/receiving dock or platform <br />and parking/loading area on the north side of <br />Davis Street west of San Leandro Boulevard. <br />This facility, which is accessible to the public <br />street system only by a single driveway on <br />Davis Street, has been used by local <br />commercial and industrial firms for minor and <br />occasional loading and unloading of rail cars <br />to and from trucks. Only a portion of the area <br />is paved with an all-weather surface suitable <br />for year-round use for parking and movement <br />of vehicles and trailers using the dock. The <br />location of the facility and the existing <br />improvements on it are inappropriate to a <br />1.28.110 <br />major regional shipping and receiving point, <br />and major activity of this sort would impact <br />adversely on adjacent public streets and <br />privately owned properties. The agency <br />determines that such activities in this location <br />are not essential to or integral with the <br />operation of the railroad, that they are <br />equivalent to and of the same nature as <br />loading and unloading activities at spur tracks <br />located on private properties elsewhere in the <br />community, and that they are subject to local <br />regulation. <br />In furtherance of the purposes of this plan <br />and enhancing the appearance, operation and <br />safety of Davis Street as a gateway, <br />thoroughfare and designated scenic route in <br />the city's general plan, the Agency may <br />establish and impose operational, <br />improvement and maintenance standards and <br />guidelines regulating use, appearance, <br />operation and maintenance of certain railroad <br />facilities and equipment, such as a <br />shipping/receiving platform or dock. The <br />purpose of regulating such facilities, to the <br />extent that such regulations do not conflict <br />with California Public Utilities Commission <br />rules and regulations, is to preclude such <br />railroad facilities from having a blighting <br />influence on adjacent public and private <br />properties and facilities. The establishment <br />and imposition of such standards and <br />guidelines will not require an amendment to <br />this plan. (Plaza 2 redev. plan § 4(K), 1988) <br />41 <br />
