.i <br />Recording Requested by and <br />After Recording Return To: <br />Redevelopment Agency of <br />City of San Leandro <br />835 East 14th Street <br />San Leandro, CA 94577 <br />I <br />Recorded in Official Records of Alameda Co. <br />Patrick O'Connell, Clerk -Recorder <br />No Fee <br />9817724 HIM 05/29/98 <br />005 341670 40 27 000062 R <br />A91 5 7.00 12.00 0.00 0.00 0.00 0.00 0.00 <br />0.00 <br />MAINTENANCE COVENANT <br />Notice is hereby given that the Redevelopment Agency of the City of San <br />Leandro ("Agency") entered into that certain Disposition and Development <br />Agreement dated May 1, 1997, with Empire Austin San Leandro Partnership <br />(hereinafter "Developer") for the purchase and development of the real property <br />commonly known as 1443-1445 East 14th Street and that certain License Agreement <br />for the use of the parking lot at 1433-1441 East 14th Street dated May 1, 1997 <br />(collectively referred to as the "Property"); and that, pursuant to Section 5.03 of the <br />Disposition and Development Agreement, the Agency hereby approves the transfer of <br />the property at 1443-1445 East 14th Street and assignment of the License Agreement <br />from the Developer to Kenneth Lee and Angela Lee (hereinafter "Purchasers"), <br />subject to the conditions set forth in this Maintenance Covenant as follows: <br />1. Purchasers shall comply with all of the terms of the License Agreement for <br />the use of the Agency owned parking lot at 1433-1441 East 14th Street. <br />2. Purchasers shall maintain the Property at all times in a neat, clean, litter - <br />free, graffiti -free and sanitary condition and in accordance with the requirements of <br />the City's Community Preservation Ordinance. <br />3. Property landscaping shall be properly irrigated, alive, and free of excessive <br />weeds. <br />4. Purchasers shall properly clean and maintain in good condition the lighting, <br />outdoor dining area and architectural elements on the exterior of the improvements. <br />5. If Purchasers do not maintain the Property as described in Paragraphs 1 <br />through 4 of this Maintenance Covenant, the Agency shall provide fifteen days <br />written notice to Purchasers of such default.
