2.28.130 Light, air and privacy. <br />In all areas sufficient space shall be <br />maintained between buildings to provide <br />adequate light, air and privacy. (Ord. 93-012 § <br />514, 1993) <br />2.28.140 Signs. <br />All signs shall be subject to the provisions <br />of the city's or county's development codes, <br />and applicable municipal or county codes, as <br />amended from time to time. (Ord. 93-012 § <br />515, 1993) <br />2.28.150 Utilities. <br />The agency shall require that all utilities be <br />placed underground when physically, legally <br />and economically feasible. (Ord. 93-012 § <br />516, 1993) <br />2.28.160 Incompatible uses. <br />No use or structure which by reason of <br />appearance, traffic, smoke, glare, noise, odor, <br />or similar factors which would be <br />incompatible with the surrounding areas or <br />structures shall be permitted in any part of the <br />project area. The agency, as with all other <br />elements of development, will coordinate with <br />the county in the unincorporated areas of the <br />project. (Ord. 93-012 § 517, 1993) <br />2.28.170 Nondiscrimination and <br />nonsegregation. <br />There shall be no discrimination or <br />segregation based upon race, color, creed, sex, <br />marital status. religion, national origin, or <br />ancestry permitted in the sale, lease, sublease, <br />transfer, use, occupancy, tenure, or enjoyment <br />of property in the project area. (Ord. 93-012 § <br />518, 1993) <br />2.28.130 <br />2.28.180 _.Mino"aria tions. <br />A. The agency board is authorized to <br />permit minor variations from the limits, <br />restrictions and controls established by this <br />plan. In order to permit such variation, the <br />agency must determine that: <br />1. The application of certain provisions of <br />this plan would result in practical difficulties <br />or unnecessary hardships inconsistent with the <br />general purpose and intent of this plan. <br />2. There are exceptional circumstances or <br />conditions applicable to the property or to the <br />intended development of the property which <br />do not apply generally to other properties <br />having the same standards, restrictions and <br />controls. <br />3. Permitting a variation will not be <br />materially detrimental to the public welfare or <br />injurious to property or improvements in the <br />area. <br />4. Permitting a variation will not be <br />contrary to the objectives of this plan or of the <br />u .nual plans of the city or county as may be y <br />applicable. <br />B. In permitting any such variation, the <br />agency shall impose such conditions as are <br />necessary to protect the public health, safety, <br />and welfare, and to assure compliance with <br />the purpose of this plan. Any variation <br />permitted by the agency hereunder shall not <br />supersede any other approval required under <br />city or county codes and ordinances. In the <br />unincorporated, the county shall provide the <br />agency with direction on such matters <br />pertaining to minor variances. (Ord. 93-012 § <br />519, 1993) <br />81 <br />
