2.36.010 <br />Chapter 2.36 <br />ADMINISTRATION AND <br />ENFORCEMENT <br />Sections: <br />2.36.010 <br />Acquisition of real <br />property. <br />2.36.020 <br />Acquisition of personal <br />property. <br />2.36.030 <br />Cooperation with public <br />bodies. <br />2.36.040 <br />Property management in <br />lieu payments. <br />2.36.050 <br />Actions by the city and <br />county. <br />2.36.060 <br />Administration, <br />enforcement and <br />amendment of the plan. <br />2.36.070 <br />Duration of this plan. <br />2.36.010 Acquisition of real property. <br />Any eminent domain proceedings on prop- <br />erties are hereby added in this section must <br />commence within twelve (12) years of the <br />effective date of the ordinance approving and <br />adopting this plan. <br />The agency may purchase, lease, obtain op- <br />tion upon or otherwise acquire any interest in <br />real property located in the project area by gift, <br />devise, exchange, purchase, or any other means <br />authorized by law. The agency will, in the unin- <br />corporated areas of the project, have the power <br />of eminent domain to acquire commercial or <br />industrial properties so zoned on the effective <br />date of the adopting ordinance for this project <br />and properties in the area north of East Lewel- <br />ling Boulevard, east of Western Pacific Rail- <br />road right-of-way. In the incorporated portion <br />of the project area, the agency will have the <br />power of eminent domain to acquire all proper- <br />ties listed on Exhibits 2.36.010(l ), 2.36.010(2), <br />2.36.010(3), 2.36.010(4), 2.36.010(5) and <br />2.36.010(6) incorporated herein by reference, <br />on the effective date of the ordinance adopting <br />Amendment No. 2 to the redevelopment plan <br />for this project. The agency will also retain the <br />power of eminent domain on a limited number <br />of industrially and commercially zoned prop- <br />erty, so zoned on the effective date of the adopt- <br />ing ordinance for Amendment No. 4 to the plan <br />and identified in Exhibits 2.36.010(7), <br />2.36.010(8), 2.36.010(9) and 2.36.010(10) to <br />Amendment No. 4. Any eminent domain pro- <br />ceedings on properties identified in Exhibits <br />2.36.010(7), 2.36.010(8), 2.36.010(9) and <br />2.36.010(10) must commence within twelve <br />(12) years of the effective date of the ordinance <br />adopting Amendment No. 4 to the plan. Any <br />eminent domain proceedings, except on the <br />properties identified in Exhibits 2.36.010(7), <br />2.36.010(8), 2.36.010(9) and 2.36.010(10) must <br />commence within twelve (12) years of the ef- <br />fective date of the ordinance approving and <br />adopting this plan. Such time limitation may be <br />extended only by amendment of this plan. Ac- <br />quisition of property will generally be achieved <br />by cooperative negotiations between the owner <br />of such property and the agency. <br />The agency shall not acquire real property <br />to be retained by an owner pursuant to a par- <br />ticipation agreement unless provisions for <br />such acquisition is made in the agreement. <br />The agency is authorized to acquire structures <br />without acquiring the land upon which those <br />structures are located. The agency is also au- <br />thorized to acquire any other interest in real <br />property less than a fee interest. <br />Property owners and developers will be <br />encouraged to participate in upgrading efforts <br />including agreements with the agency for fi- <br />nancial and other incentives.
