3.03 Form of Nondiscrimination and Nonsegregation Clause <br />The Participant shall not make or enter into any deeds, leases or contracts restricting the rental, <br />sale or lease of the Site on the basis of sex, marital status, race, color, creed, religion, ancestry or <br />national origin of any person and all deeds, leases, or contracts respecting the use or occupancy of the <br />Site shall contain, or be substantially subject to, the following nondiscrimination clauses: <br />A. Deeds: "The grantee herein covenants by and for himself, his heirs, executors, <br />administrators and assigns, and all persons claiming under or through him, that there shall be no <br />discrimination against or segregation of, any person or group of persons on account of sex, marital status, <br />race, color, creed, religion, national origin or ancestry in the sale, lease, sublease, transfer, use, <br />occupancy, tenure or enjoyment of the land herein conveyed, nor shall the grantee himself or any person <br />claiming under or through him, establish or permit any such practice or practices of discrimination or <br />segregation with reference to the selection, location, number, use or occupancy of tenants, lessees, <br />subtenants, sublessee or vendees in the land herein conveyed. The foregoing covenants shall run with <br />the land." <br />B. Leases: "The lessee herein covenants by and for itself, its heirs, executors, <br />administrators and assigns and all persons claiming under or through it, and this lease is made and <br />accepted upon and subject to the following conditions: That there shall be no discrimination against or <br />segregation of any person or group of persons, on account of sex, marital status, race, color, creed, <br />religion, national origin, or ancestry, in the leasing, subleasing, transferring, use or enjoyment of the land <br />herein leased nor shall the lessee itself, or any person claiming under or through it, establish or permit <br />any such practice or practices of discrimination or segregation with reference to the selection, location, <br />number, use or occupancy, of tenants, lessees, subtenants, sublessee, or vendees of the land herein <br />leased." <br />C. Contracts: "There shall be no discrimination against or segregation of any person, or <br />group of persons on account of sex, marital status, race, color, creed, religion, national origin or ancestry <br />in the sale, lease, sublease, transfer, use, occupancy, tenure or enjoyment of the land, nor shall the <br />transferee itself or any person claiming under or through it, establish or permit any such practice or <br />practices of discrimination or segregation with reference to the selection, location, number, use or <br />occupancy of tenants, lessees, subtenants, sublessee, or vendees of the land." <br />3.04 Effect and Duration of Covenants, Agreements and Conditions <br />All of the terms, covenants, agreements and conditions set forth in this Agreement shall cease <br />and terminate ten years from Commencement Date, excepting only the provisions of this Agreement with <br />respect to the construction of the Improvements which shall terminate upon issuance of a Certificate of <br />Occupancy for the Improvements pursuant to Section 3.06.H of this Agreement and excepting only the <br />provisions of this Agreement relating to nondiscrimination, which shall remain in effect in perpetuity. <br />3.05 Permits and Approvals <br />The Participant shall be responsible for, and promptly pay when due, all customary and <br />reasonable fees and charges of any governmental agency having jurisdiction over the construction and <br />development of the Improvements in connection with the processing and consideration of any permits or <br />approvals for the Project. The Participant, on behalf of itself, acknowledges and agrees that execution of <br />this Agreement by the Agency does not constitute approval of permits for the construction and <br />development of the Improvements, does not limit in any manner the discretion of the City in such approval <br />process, and does not relieve the Participant from the obligation to obtain all necessary permits, including <br />building permits, for the construction of the Improvements. Construction of the Improvements shall not be <br />permitted prior to issuance of all required building permits. <br />
