3.06 Special Provisions <br />A. The Design Plans shall consist of: <br />1. The site plans submitted to the City Zoning Enforcement Official dated <br />September 28, 2001 by Marek Stoklosa which plans are attached and incorporated into <br />this Agreement as Exhibit C. <br />2. The detailed engineering, landscaping and elevation plans attached and <br />incorporated into this Agreement as Exhibit D which shall include: <br />a. Representative samples of materials and colors to be incorporated into <br />the Improvements, <br />b. The plant types used and their quantities and locations, <br />C. Depictions of a minimum (a) ten foot landscaped set back along the <br />entire Merced Street frontage and (b) four foot landscaped area for a minimum of <br />70 feet each along the southern side yard. <br />3. All Conditions of Approval. <br />B. Signage <br />1. All signs proposed for the exterior of the Site shall be subject to the Agency's <br />review and approval prior to installation on the Site. <br />2. The Participant is responsible for the installation and cost, in accordance with <br />City specifications, of constructing signage identifying the Project as an Agency - <br />sponsored development. The Participant shall maintain such signage in good repair <br />throughout the period of construction and development of the Improvements as detailed <br />in this Agreement. <br />C. Maintenance of the Site <br />The Participant shall properly maintain all work on the Site in a reasonably neat, clean and <br />presentable condition. The Participant shall promptly complete all repair and maintenance work as <br />required by the Agency, provided that such requirements of the Agency are reasonable in relation to the <br />standard of repair of other buildings and improvements of similar age and construction in the Project Area <br />which have been improved under requirements of the Redevelopment Plan. The Participant shall <br />promptly repair any damage that may occur to the Improvements due to fire, earthquake or other <br />calamity, or shall clear the Site of all structures and debris. The Participant shall prevent the <br />accumulation of dirt, grease and debris, and remove weeds and trash or other debris from the Site and <br />shall, at all times, maintain all landscaped and unimproved areas in a reasonably neat, clean, litter -free <br />and weed -free condition. All trees, shrubs and ground covers shall be maintained in a reasonably healthy <br />and growing condition at all times and shall be pruned regularly and properly staked. <br />D. Improvements <br />All development and construction of the Improvements on the Site by the Participant shall be as <br />provided for in the Design Plans. The Improvements shall be constructed over a twelve-month period <br />beginning on the Commencement Date. The Participant acknowledges that it shall prepare, submit, and <br />obtain approval by the City and the Agency of the Design Plans. The Participant covenants on behalf of <br />itself that it shall, prior to issuance of any building permits, obtain all other necessary permits and <br />approvals which may be required by any governmental agency having jurisdiction over the construction or <br />
