3.04.030 <br />pared this plan pursuant to the Community <br />Redevelopment Law of the state of California <br />(The "CRL") (Health and Safety Code, Sec- <br />tion 33000 et seq.) and all applicable local <br />codes and ordinances. Statutory changes en- <br />acted after adoption of this plan, which are <br />applicable to the agency, the project area, or <br />the plan, shall supersede the requirements of <br />the plan, whether or not the plan is formally <br />amended to reflect such changes. <br />The Plan sets forth the agency's powers, <br />duties, and obligations to implement the rede- <br />velopment program for the project area. The <br />plan does not constitute a specific plan for the <br />project area or set priorities for specific pro- <br />jects. Rather, the plan provides a framework <br />and process for preparing specific plans, es- <br />tablishing priorities, and proposing solutions <br />for specific problem areas. (Ord. 99-025 <br />§ 102, 1999) <br />3.04.030 Boundary and legal <br />description. <br />The boundaries of the project area are <br />shown on the redevelopment plan map (the <br />"map") attached as Appendix A and are de- <br />scribed in the legal description of the project <br />area attached as Appendix B. (Ord. 99-025 <br />§ 201, 1999) <br />3.04.040 Influences on the project <br />area. <br />The project area consists of a total of ap- <br />proximately one thousand forty (1.040) acres <br />divided into two sub -areas: the West San <br />Leandro Sub -Area and the MacArthur Boule- <br />vard sub -area. <br />The West San Leandro sub -area consists of <br />approximately one thousand twenty-four <br />(1,024) acres and primarily contains industrial <br />and commercial properties. The sub -area en- <br />compasses nearly all non-residential proper- <br />ties west of Interstate 880, north of Burroughs <br />Avenue. All properties within the West San <br />Leandro sub -area are predominantly urban- <br />ized and none are in agricultural use. A num- <br />ber of structures are older, poorly maintained <br />and inadequate to meet the requirements of <br />businesses located in or potentially relocating <br />to the area. This is evidenced by instances of <br />inadequate setbacks, utilities and loading ar- <br />eas; building deterioration and dilapidation; <br />faulty additions; outdoor storage and produc- <br />tion; and underutilized structures. <br />The MacArthur Boulevard portion of the <br />project area consists of approximately sixteen <br />(16) acres located along MacArthur Boulevard <br />between Durant Avenue and Joaquin Avenue <br />(including a parcel just south of Joaquin Ave- <br />nue). Most of the properties are commercially <br />zoned and consist of vacant parcels, older <br />shopping centers, professional buildings and <br />some newer retail establishments. All proper- <br />ties within the MacArthur Boulevard sub -area <br />are predominantly urbanized and none are in <br />agricultural use. A number of structures are <br />older, poorly maintained and inadequate to <br />meet the requirements of businesses located in <br />or potentially relocating to the area. This is <br />evidenced by instances of inadequate set- <br />backs, utilities and loading areas; building <br />deterioration and dilapidation; faulty addi- <br />tions; outdoor storage; and underutilized <br />structures. <br />Both sub -areas were selected for redevel- <br />opment because a significant portion of each <br />area is blighted as described above. In addi- <br />tion, both the West San Leandro subarea and <br />the MacArthur Boulevard sub -area are charac- <br />terized by the existence of inadequate public <br />improvements that limit the use and reuse of <br />properties. These include vehicular circulation <br />problems, parking deficiencies, and deterio- <br />rated pavement.
