Chapter 3.20 <br />PUBLIC IMPROVEMENTS AND SITE <br />PREPARATION <br />Sections: <br />3.20.010 <br />Demolition and clearance. <br />3.20.020 <br />Removal of graffiti. <br />3.20.030 <br />Public improvements. <br />3.20.040 <br />Financing of facilities or <br />capital equipment. <br />3.20.050 <br />Preparation of building <br />sites. <br />3.20.060 <br />Hazardous waste. <br />3.20.010 Demolition and clearance. <br />The agency is authorized to demolish and <br />clear or move buildings, structures, and other <br />improvements from any real property in the <br />project area as it determines necessary or <br />convenient to carry out the purposes of the <br />plan. (Ord. 99-025 § 209.1, 1999) <br />3.20.020 Removal of graffiti. <br />The agency may take any actions within the <br />project area that the agency determines are <br />necessary to remove graffiti from public or <br />private property upon making a finding that, <br />because of the magnitude and severity of the <br />graffiti within the project area the action is <br />necessary to effectuate the purposes of the <br />plan and that the action will assist with the <br />elimination of blight. (Ord. 99-025 § 209.2, <br />1999) <br />3.20.030 Public improvements. <br />A. Subject to the requirements of Health <br />and Safety Code Section 33445, the agency is <br />authorized to pay all or a part of the value of <br />the land for and the cost of the installation and <br />3.20.010 <br />construction of any building, facility, <br />structure, or other improvement which is <br />publicly owned either within or without the <br />project area. Such payments are subject to the <br />city council's finding all of the following: <br />1. That the buildings, facilities, structures, <br />or other improvements are of benefit to the <br />project area or the immediate neighborhood in <br />which the public improvement is located; <br />2. That no other reasonable means of <br />financing the buildings, facilities, structures, <br />or other improvements are available to the <br />city; and <br />3. That the payment of funds for the <br />acquisition of land or the cost of buildings, <br />facilities, structures, or other improvements <br />will assist in the elimination of one or more <br />blighting conditions inside the project area or <br />provide housing for low- or moderate -income <br />persons, and is consistent with the <br />implementation plan for the project. <br />B. Such determinations by the agency and <br />the city council shall be final and conclusive. <br />The agency may pay all or part of the value of <br />the land for and the cost of the installation and <br />construction of any building, facility, structure <br />or other improvement set forth in Appendix C <br />to the plan, "proposed public improvements <br />and facilities projects" <br />C. When the value of the land or the cost <br />of the installation and construction of the <br />public improvement has been or will be paid <br />or provided for initially by the city or other <br />public corporation, the agency may enter into <br />a contract with the city or other public <br />corporation under which it agrees to <br />reimburse the city or other public corporation <br />for al I or part of the value of the land or all or <br />part of the cost of the building, facility, <br />structure, or other improvement, or both, by <br />periodic payments over a period of years. <br />131 <br />
