3.16.040 <br />3.16.040 Displaced persons of low <br />and moderate income. <br />The agency's method or plan for relocation <br />shall provide that no persons or families of <br />low and moderate income shall be displaced <br />unless and until there is a suitable housing <br />unit available and ready for occupancy at rents <br />comparable to those at the time of their <br />displacement. Such housing units shall be <br />suitable to the needs of such displaced persons <br />or families and must be decent, safe, sanitary, <br />and otherwise standard dwellings. The agency <br />shall not displace such person or family until <br />such housing units are available and ready for <br />occupancy. <br />If suitable housing units are not available in <br />the city for low- and moderate -income <br />persons and families who will be displaced <br />from the Project Area, the city council shall <br />assure that sufficient land is made available <br />for such housing. The agency may direct or <br />cause the development, rehabilitation or <br />construction of such housing within the city, <br />both inside and outside of the project area, as <br />needed to correct the deficiency in housing for <br />displaced low- and moderate -income persons <br />and families. <br />Whenever all or any portion of the project <br />area is developed with low- or moderate - <br />income housing units, the agency shall require <br />by contract or -other appropriate means that <br />such housing be made available for rent or <br />purchase to the persons and families of low or <br />moderate income displaced by the project. <br />Such persons and families shall be given <br />priority in renting or buying such housing. <br />(Ord. 99-025 § 208.4, 1999) <br />3.16.050 Relocation payments. <br />The agency shall make fair and reasonable <br />relocation payments as prescribed by the state <br />guidelines and the agency's relocation rules <br />and regulations. If there is any conflict <br />between the agency's rules and regulations <br />and the state guidelines, the state guidelines <br />shall control. The agency may exceed the <br />maximum payments established in the state <br />guidelines in accordance with agency policy <br />establishing the requirements and conditions <br />for providing excess payments.
