In <br />giving consent, the city council shall make a <br />finding that providing such improvements is <br />necessary to effectuate the purposes of the <br />plan. <br />D. Pursuant to Health and Safety Code <br />Section 33426.5, the agency shall not provide <br />any form of direct assistance to the following: <br />1. An automobile dealership that will be or is <br />on a parcel of land that has not previously <br />been developed for urban use. <br />2. A development that will be or is on a <br />parcel of land of five acres or more that has <br />not previously been developed for urban use <br />and that will, when developed, generate sales <br />or use tax pursuant to Revenue and Taxation <br />Code Section 7200 et seq., unless the principal <br />permitted use of the development is office, <br />hotel, manufacturing, or industrial. <br />3. A development or business, either <br />directly or indirectly, for the acquisition, <br />construction, improvement, rehabilitation, or <br />replacement of property that is or would be <br />used for gambling or gaming of any kind <br />whatsoever including, but not limited to, <br />casinos, gaming clubs, bingo operations, or <br />any facility wherein banked or percentage <br />games, any form of gambling device, or <br />lotteries, other than the California State <br />Lottery, are or will be played. (Ord. 99-025 § <br />209.5, 1999) <br />3 20.060 Hazardous waste. <br />The agency may take any actions that it <br />determines are necessary and that are <br />consistent with other state and federal laws to <br />remedy or remove a release of hazardous <br />substances on, under, or from property within <br />the project area whether the agency owns that <br />property or not, subject to provisions <br />3.20.060 <br />contained in Health and Safety Code Section <br />33454 et seq., commonly referred to as the <br />Polanco Act.
