3.24.010 <br />Chapter 3.24 <br />PROPERTY DISPOSITION AND <br />DEVELOPMENT <br />Sections: <br />3.24.010 <br />Real property disposition. <br />3.24.020 <br />Disposition and <br />development documents. <br />3.24.030 <br />Nondiscrimination <br />provisions. <br />3.24.040 <br />Development plans. <br />3.24.050 <br />Personal property <br />disposition. <br />3.24.010 Real property disposition. <br />The agency may, within the project area or <br />for purposes of redevelopment, sell, lease for <br />a period not to exceed ninety-nine (99) years, <br />exchange, subdivide, transfer, assign, pledge, <br />encumber by mortgage, deed of trust, or <br />otherwise, or otherwise dispose of any real <br />property or any interest in property. The <br />agency is authorized to dispose of real <br />property by negotiated lease, sale, or transfer <br />without public bidding, but only after noticed <br />public hearing. <br />Before any of the agency's property that <br />was acquired in whole or in part, directly or <br />indirectly, with tax increment moneys is sold <br />or leased for development pursuant to the <br />plan, the sale or lease shall first be approved <br />by the city council by resolution after public <br />hearing in conformance with Health and <br />Safety Code Section 33433. <br />The agency shall lease or sell all real <br />property acquired by it in the project area, <br />except that it may transfer property to the city <br />or other public body for any amount of <br />consideration or without requiring any <br />consideration at all. <br />The agency shall obligate persons <br />purchasing or leasing property from the <br />agency to use the property for the purpose <br />designated in the plan, to begin redevelopment <br />within a reasonable period of time, to comply <br />with the covenants, conditions, or restrictions <br />that the agency deems necessary to prevent <br />speculation or excess profit taking in <br />undeveloped land, including right of reverter <br />to the agency, and to comply with other <br />conditions that the agency deems necessary to <br />carry out the purposes of the plan. (Ord. 99- <br />025 § 210.1, 1999) <br />3.24.020 Disposition and <br />development documents. <br />The agency may enter into agreements for <br />the lease or sale and development of real <br />property in the project area. Such agreements <br />shall contain provisions as needed to prevent <br />speculation in the property and to ensure that <br />development is carried out in a timely manner <br />pursuant to the plan. <br />Every sale, lease, or other conveyance of <br />real property owned by the agency shall be <br />conditioned on compliance with the plan, the <br />zoning ordinance goveming the property, and <br />any conditions imposed by the agency through <br />agreements, declarations of restrictions, <br />conditional use permits, or other means. The <br />agency may require the recording of any <br />document pertaining to the sale, lease, or other <br />conveyance, or to the use of such property. <br />Conveyance documents may create rights of <br />reversion in favor of the agency or other <br />provisions deemed necessary to carry out the <br />purposes of the plan.
