public rights -of -way referred to in Paragraph 1 and.4) a true and <br />correct copy of an application entitled: <br />In the Matter of the Application of the City <br />of San Leandro to Abandon a Public Street <br />Across a Railroad of the Southern Pacific <br />Transportation Company at Thorton Street and <br />to Abandon a Public Street Across a Railroad <br />of the Southern Pacific Transportation Company <br />at West Estudillo Avenue and to Construct a <br />Public Street Across a Railroad of the <br />Southern Pacific Transportation Company at <br />Alvarado Street, San Leandro, California <br />The Company shall deposit 1) its grant deed or deeds duly <br />authorized and acknowledged; 2) its standard form cooperative <br />agreement for crossings D-14.7 and D-14.96 duly authorized and <br />acknowledged; and 3) assignments of various track agreements licenses <br />and leases pertaining to the subject premises. <br />Each party shall submit escrow instructions consistent with this <br />agreement. The City shall bear all costs of title insurance (if any), <br />recording fees and escrow fees. <br />12. This agreement constitutes the entire understanding of the <br />parties, and no prior statements, documents, memoranda or reports <br />shall be construed to modify or abridge any provisions hereof. <br />13.
