1.20.010 <br />Chapter 1.20 <br />OWNER PARTICIPATION <br />Sections: <br />1.20.010 <br />General. <br />1.20.020 <br />Rules and regulations <br />governing owner <br />participation. <br />1.20.030 <br />Owner participation <br />agreements. <br />1.20.040 <br />Standards. <br />1.20.050 <br />Alternate provisions on <br />failure of owner to <br />participate. <br />1.20.010 General. <br />The improvement of existing buildings <br />by their owners is one of the primary objec- <br />tives of Plaza 1. <br />In order to achieve this objective, and in <br />order to protect the investments of property <br />owners who undertake substantial remodel- <br />ing and rehabilitation work, a uniform and <br />equitable owner participation program in <br />Plaza 1 is necessary. Property owners will <br />be given the opportunity to participate by <br />coordinating remodeling and rehabilitation <br />work with the execution of a new lease or <br />lease renewal. The plan includes a positive <br />approach to insure that remodeling and re- <br />habilitation work are carried out properly <br />and promptly throughout the project area. <br />(33339) <br />Participation opportunities shall neces- <br />sarily be subject to and limited by such fac- <br />tors as the need for expansion of public fa- <br />cilities; elimination, relocation and/or modi- <br />fication of land uses; realignment and aban- <br />donment of streets; the ability of participants <br />to finance acquisition and development in <br />accordance with the plan; reduction of the <br />total number of, or change in the sizes of, <br />individual parcels in the project area; and <br />change in orientation and character of the <br />area, or portion of the area; and preservation <br />of existing buildings which have historical <br />and/or architectural qualities that will en- <br />hance the plan. <br />The extent to which participation oppor- <br />tunities are feasible and afforded to property <br />owners in the project area shall be at the sole <br />discretion of the agency. <br />In carrying out the objectives of the plan, <br />the agency may establish or appoint such <br />committee or subcommittee as are necessary <br />to assist the agency in achieving those ob- <br />jectives by developing and implementing <br />policies and development standards related <br />to, but not limited to, sign control, architec- <br />tural treatment of structures, occupancy of <br />buildings, on -site pedestrian and vehicular <br />circulation, driveway locations, and prohib- <br />iting or restricting uses which may have ad- <br />verse traffic generating characteristics in- <br />consistent with the objectives of the plan. <br />(Plaza 1 redev. plan § 11(A), 1986) <br />1.20.020 Rules and regulations <br />governing owner <br />participation. <br />A. The owner participation program <br />providing for the repair, renovation and re- <br />newal of existing structures by their owners <br />shall be subject to the following regulations: <br />1. Approval of the redevelopment <br />agency will be required before any of the <br />following shall occur: <br />a. Issuance of any building, plumbing <br />or electrical permit within the project area; <br />or <br />b. Any change in use or occupancy of <br />any property or portion thereof.
