1.20.050 <br />the building is such that strict adherence to all <br />improvement standards would seriously and <br />adversely affect the operation of such use. <br />(Plaza 1 redev. plan § I I (D), 1986) <br />1.20.050 Alternate provisions on <br />failure of owner to <br />participate. <br />In the event of failure of the owner to <br />participate in accordance with the owner <br />participation provisions of this plan, the <br />redevelopment agency may acquire the <br />property through eminent domain or as <br />otherwise provided in any owner participation <br />agreement for subsequent disposition for <br />renovation according to standards established <br />by this plan and use in accordance with this <br />plan. This alternate procedure will become <br />effective only if the owner fails to make <br />required improvements or enter into an owner <br />participation agreement within a period of six <br />months following termination of an existing <br />lease, tenancy or use. The agency may, on its <br />own motion or by application of the owner, <br />extend this period for an additional period or <br />periods of six months. Execution of an owner <br />participation agreement prior to actual <br />acquisition by the agency, and reimbursement <br />to the agency by the owner of any costs <br />incurred in pursuance of such acquisition <br />under this alternate procedure, will reinstate <br />the owner participation provisions of the plan. <br />(33340) (Plaza I redev. plan § 11(E), 1986) <br />18 <br />
