City Manager FROM: William K A I ;re D' .-APPROVED AND FORWARDED TO CITY COUNCILp�,_ Jo ermanis Ci anager v b , erector ?-€ngineering and Transportation Department BY: Uchenna Udemezue, P.E., City Engine SUBJECT PROJECT/PROJECT DESCRIPTION: 1 RESOLUTION ACCEPTING THE TRANSFER OF RIGHT-OF-WAY OF EMBERS WAY BETWEEN LEWELLING BOULEVARD AND HESPERIAN BOULEVARD FROM THE STATE DEPARTMENT OF TRANSPORTATION (CALTRANS) SUMMARY AND RECOMMENDATION Staff recommends that the City Council accept the transfer of right-of-way of Embers Way between Lewelling Boulevard and Hesperian Boulevard from the State Department of Transportation (CALMNINS) and waive the 90-day Notice of Intention to Relinquish. BACKGROUND On March 11. 1986. CALTRANS and Alameda County signed the Freeway Agreement regarding the Freeway I-238 and I-880 Interchange construction. Per the agreement. Alameda County agreed to accept the title to the portions of such roads lying outside the freeway limits, upon relinquishment by the State. Subsequently it was discovered that Embers Wav and a portion of Lewelling Boulevard which were actually within San Leandro City limits are a part of the right-of-way covered by the agreement. As a result of the completion of this Interchange. the State no longer needs Embers Way and is willing to relinquish the right-of-way pursuant to the agreement with the County. Caltrans staff has prepared a map (Exhibit A) that shows the area of relinquishment. The adopted City resolution would be sent to CALTRANS staff who then will submit a relinquishment request to the California Transportation Commission (CTC) for approval. Also. staff recommends waiving and subsequent filing of the 90-day Notice of Intention to relinquish Embers Way ,17E
