Agreement. <br />4. Concurrently with this Agreement, William Peluso shall execute a <br />personal services agreement to utilize the Blue Dolphin facility for restaurant and <br />banquet uses from the date of this Agreement through December 31, 1995. Such <br />personal services agreement shall not be assignable. Any extensions to such personal <br />services agreement shall be at the sole and absolute discretion of the City. Such <br />personal services agreement shall include the following terms and conditions: <br />A. Banquet deposits will not be accepted for bookings or events <br />scheduled after December 31, 1995; <br />B. Banquet deposit refunds will be given: (1) upon request of customers <br />if they provide thirty (30) days advance notice of cancellation, or (2) in the <br />event William Peluso elects to terminate restaurant operation prior to <br />providing the banquet to the customer who has placed a deposit. <br />C. William Peluso shall be responsible for the payment of gas, electric, <br />and water bills and charges; <br />D. William Peluso shall be responsible for normal maintenance of the <br />Blue Dolphin facility; <br />E. William Peluso shall remain responsible for obtaining and keeping <br />current liability and workers compensation insurance coverages; <br />F. William Peluso shall be responsible for meeting all obligations to <br />suppliers, employees, labor unions, and federal and state tax collection <br />Agreement to Terminate Lease, <br />Assign Rights and Quitclaim 4 <br />
