CA 94577 <br />Attn Community Development Director <br />EXEMPT FROM RECORDING FEES PER <br />r(')VFRNMFNT (I.onF 6SR1n3 773R3 <br />Space above this line for Recorder's use. <br />APN: 077A-0660-108-00 <br />FIRST AMENDMENT TO DEED OF TRUST WITH ASSIGNMENT OF RENTS <br />This FIRST AMENDMENT to that certain Deed of Trust with Assignment of <br />Rents, dated December 3, 1993, (this "First Amendment") is made as of <br />%v✓�vt� {- Z 2018, by the Ulrich Family Trust, a trust created by that certain <br />instrument dated May 21, 1990 and existing under the laws of the State of California <br />(the "Trustor"), to the City of San Leandro, a California charter city, as trustee (the <br />"Trustee"), for the benefit of the City of San Leandro, a California charter city (the <br />"Beneficiary"). The Trustor and the Beneficiary are hereinafter collectively referred to <br />herein as the "Parties." <br />RECITALS <br />A. The Trustor owns fee simple title to the land located at 1067 Donovan <br />Drive, San Leandro, County of Alameda, State of California, described in Exhibit A <br />attached hereto and incorporated herein by this reference (the "Land"). <br />B. On December 3, 1993, Trustor executed that certain promissory note <br />("Original Note") in the original principal sum of Twenty -Three Thousand Two Hundred <br />Sixty -Three Dollars and Nineteen Cents ($23,263.19) ("Original Loan"), payable to <br />Beneficiary, evidencing a loan in the same amount to Trustor pursuant to the <br />Beneficiary's Owner Rehabilitation Program. The Original Loan was identified as loan <br />number 3720033. The Original Loan is secured by that certain Deed of Trust With <br />Assignment of Rents, executed by Trustror on December 3, 1993, and recorded on <br />March 17, 1994 in the Official Records of the County of Alameda as Instrument Number <br />94103963 ("Original Deed of Trust"). <br />C. The Beneficiary and the Trustor have decided to amend the terms of the <br />Original Loan and have entered into an amended and restated residential rehabilitation <br />loan agreement dated as of the date hereof (the "Amended Agreement") pursuant to <br />which the Beneficiary will provide a loan to the Trustor a sum of up to Thirty Five <br />Thousand Four Hundred Sixteen Dollars and Thirty Seven Cents ($35,416.37) (the <br />
