File #1jl <br />1 AGREEMENT <br />2 THIS AGREEMENT, MADE AND ENTERED INTO THIS llth DAY <br />3 OF OCTOB ER , 1971, BY AND BETWEEN <br />4 CITY OF SAN LEANDRO, a body <br />5 politic and a municipal corporation <br />i <br />6 of the State of California, <br />7 hereinafter referred to as "CITY" <br />8 AND <br />9 STATE OF CALIFORNIA, acting by <br />to and through its Business and <br />11 Transportation Agency, Department I <br />� <br />12 of Public Works, Division of <br />13 Highways, hereinafter referred to <br />14 as "STATE". <br />15 WITNESSETH: <br />16 WHEREAS, CITY is contemplating a new four -lane street <br />17 (Springlake Drive) which will serve an 840-unit apartment complex <br />18 and will be only 150 feet north of the existing State Route 238 <br />19 off -ramp terminal at Hesperian Boulevard and would create traffic <br />I <br />20 congestion both on the ramp and on Hesperian Boulevard; and <br />21 WHEREAS, CITY has requested and STATE is willing to revise <br />22 the existing Westbound Hesperian Boulevard off -ramp from State <br />23 Route 238 and relocate said ramp approximately 300 feet west of <br />I <br />24 Hesperian Boulevard, terminating on Springlake Drive; and <br />25 <br />WHEREAS, the ramp revision will eliminate the possibility <br />26 of two intersections only 150 feet apart on Hesperian Boulevard <br />27 and will increase the southbound weaving distance on Hesperian <br />[DUPLICATE ORIGUNIAL" <br />
