-00 RF:52081M:Sd7 RESOLUTION NO. 1545 (Sale of Portion of Pacific High School/Maintenance Department Sites) WHEREAS, the following described real property belonging to the San Leandro Unified School District of Alameda County, State of California, a public corporation, will not at the time of delivery of title or possession as hereinafter provided, be needed for school classroom buildings by said School District, to wit, all that real property in the City of San Leandro, County of Alameda, State of California, popularly known as the Teagarden Extension, more particularly described in Exhibit A attached here- to and by this reference incorporated herein; and WHEREAS, a Negative Declaration has been prepared and filed in accordance with Public Resources Code Section 21000, et seq.; NOW, THEREFORE, BE IT RESOLVED that pursuant to the provisions of Section 39500 to 39502, inclusive, of the Education Code of the State of California, title and fee to the real property hereinabove described shall be granted and conveyed to the City of San Leandro, a municipal corporation of the State of California for public street and roadway purposes, subject to any and all unpaid taxes, assessments, easements, rights of way, restrictions, reservations, conditions, deeds of trust, liens, and encumbrances thereon, of any nature or kind whatsoever, in consideration of the City of San Leandro paying to the San Leandro Unified School District the amount of $10.00 and in consideration of the benefits which will accrue to this school district from the maintenance of said real property by the City of San Leandro; and BE IT FURTHER RESOLVED that this sale shall be subject to the following terms and conditions: 1. For and in consideration of the aforesaid purchase price, the San Leandro Unified School District agrees to convey to the City of San Leandro the fee to said land by grant deed for public street and roadway purposes and subject to the easements, liens, and other encumbrances thereon.
