Page 2 <br />Caterpillar Tractor Co. <br />November 3, 1971 <br />Sheet 1 of Exhibit A. The portion of right of way to be granted <br />at the corner of Martinez and Antonio is not exactly as shown on <br />the drawing and has been modified as you requested to be at least <br />1' clear of the building foundation. The exact detail of this <br />parcel, which as shown will clear the building by about 1 112'. <br />is shown on our Drawing 547, Case 1602. A sepia copy of the <br />drawing is included in case you wish to make it a part of your <br />exhibit and save some detailed draftinn. <br />In reference to your letter forwarded on October 25, 1971, concerning the <br />understandings and intentions with regard to the future disposition of <br />the sanitary and storm sewers between Davis and Antonio, the only suggested <br />change is as indicated in paragraph one relating to vacation. This change <br />consists of the addition of the words "undertake all Proceedings necessary <br />to" and is necessary for the same reasons set forth above. <br />If the above modifications are acceptable to your company, Please have two <br />copies of the cost --sharing agreement and the letter of future intention <br />signed and returned to us at your earliest convenience. <br />In the meantime, we are continuing with construction plans and hope to have <br />them to you for approval within 60 days. <br />Very truly yours, <br />Glenn A.
