s <br />IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />ORDINANCE NO. 62 - 41 <br />AN ORDINANCE VACATING MARTELL COURT <br />Whereas, the City Council of the City of San Leandro on july 16, <br />1962, passed its Resolution of Intention No. 62-118 to vacate Martell <br />Court (a public street in the City of San Leandro) as hereinafter <br />described, and <br />Whereas., a public hearing was set for August 6, 1962, at which <br />time any person objecting to such vacation was given the opportunity <br />to appear and show cause why such vacation sheuld not be ordered, and <br />notice of such meeting was duly published and posted; and <br />Whereas, such hearing was held by the City Council on August 6, <br />1962, and the City Council at the time of such hearing determined that <br />except for the reservations and exceptions hereinafter set forth, said <br />Martell Court was unnecessary for present or prospective public use: <br />Now, therefore, the City Council of the City of San Leandro does <br />ORDAIN as follows: <br />Section 1. That except for the reservations and exceptions here- <br />inafter set forth, Martell Court, a public street located within the <br />City of San Leandro, Alameda County, California, is unnecessary for <br />present or p-ospective public use and said Martell Court be and it,. <br />hereby is vacated and abandoned; said Martell Court is more particularly <br />described as fol?ows- <br />All o* Martell Court bet.A+een the intersection thereof <br />of Harold A„,enue and the westerly termination of said <br />Martell Court. <br />Section 2. The City retains, for the benefit of all interested <br />parties, the folloN;ng reservations and exceptions: easements pursuant <br />to existing franchises therefor to construct, maintain, operate, replace, <br />remove, renew, and enlarge lines of pipe, conduits, cables, wires, poles, <br />and other convenient structures, equipment, and fixtures for the opera- <br />tion of gas pipe lines, telegraphic and telephone lines, for the <br />
