IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO.2022-183 RESOLUTION OF THE CITY OF SAN LEANDRO CITY COUNCIL TO APPROVE AMENDMENT 3 TO AN EXISTING CONSULTING SERVICES AGREEMENT WITH KLEINFELDER, INC. TO EXTEND THE CONTRACT TERM AND INCREASE THE AMOUNT OF COMPENSATION BY $57,103 FOR A TOTAL NOT TO EXCEED AMOUNT OF $100,941 AND TO AUTHORIZE ADDITIONAL CUMULATIVE AGREEMENT AMENDMENTS UP TO 10% ($10,094) FOR THE WASHINGTON MANOR PARK IRRIGATION WELL REPLACEMENT PROJECT, PROJECT NO.2022.3060 WHEREAS, an agreement dated March 15, 2019 exists between the City of San Leandro and Kleinfelder; and WHEREAS, a contract amendment is required to extend the term and compensate for additional consulting services related to design, construction administration, and field observation; and WHEREAS, Kleinfelder has agreed to the terms of the amendment pending Council approval; and WHEREAS, Amendment No. 3 to the agreement, of which a copy of the scope and compensation are attached, was presented to this City Council; and WHEREAS, the City Council is familiar with the contents thereof, and WHEREAS, the City Manager recommends approval of said agreement. NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: 1. That said Amendment No. 3 substantially in the form presented is hereby approved and execution by the City Manager is hereby authorized; and 2. That the City Manager is authorized to make non -substantial revisions to said agreement, subject to approval as to form by the City Attorney; and 3. That the City Manager or her designee is authorized to negotiate and approve cumulative change orders up to 10%, or $10,094 of the revised total contract amount; and 4. That an original executed agreement with Amendments 1, 2, and 3 shall be attached to and made a part of this resolution.
