<br />RESOLUTION NO. 76 - 392
<br />RESOLUTION OF INTENTION TO VACATE
<br />A PORTION OF HOMANS AVENUE
<br />The City Council of the City of San Leandro does RESOLVE as follows:
<br />That the City Council hereby elects to proceed under the provisions of
<br />Chapter a.l of Title V of the San Leandro Municipal Code of 1957.
<br />It is the intention of the City Council to vacate a portion of Homans
<br />Avenue. Said Homans Avenue is a public street in the City of San Leandro, Alameda
<br />County, California, officially known and designated as Romans Avenue. That portion
<br />of Homans Avenue so proposed to be vacated and abandoned is described as follows:
<br />Real property in the City of San Leandro, Countv of Alameda, State
<br />of California, being a portion of Homans Avenue, as said Avenue is
<br />shown on "Map No. 1, Bellevue Park Tract," filed November 28, 1894
<br />in Map Book 17, at page 68, Alameda County Records, and being fur-
<br />ther described as follows:
<br />Beginning at the intersection of the northwest line of East Juana
<br />Avenue with the southwest line of Homans Avenue, as said Avenues
<br />are shown on the said map of the Bellevue Tract; thence northwest-
<br />erly along the last said line 100 feet; thence northeasterly, at
<br />right angles, 20 feet; thence southeasterly, at right angles, 100
<br />feet to the northeasterly prolongation of the said northwest line
<br />of East Juana Avenue; thence southwesterly along the last said line,
<br />20 feet, to the BEGINNING.
<br />The above described parcel of land contains 2,000 square feet, more
<br />or less.
<br />These proceedings are taken subject to the reservation and exception
<br />therefrom of an easement and right in and for the benefit of the City of San
<br />Leandro and any public or private utility having an interest therein, at any
<br />time, or from time to time, to enter upon and to construct, maintain, operate,
<br />replace, remove, and renew sanitary sewers, and storm drains and appurtenant
<br />structures, to construct, maintain, operate, replace, remove, renew and enlarge
<br />lines of pipe, conduits, cables, wires, poles and other convenient structures,
<br />equipment, and fixtures for the operation of television, telegraphic and tele-
<br />phone lines, for the transportation or distribution of electric energy, and for
<br />the transportation of water or natural gas, including access and the right to
<br />keep the property free from inflammable materials, and weed growth, and other-
<br />wise protect the same from all hazards, in, upon and over the entire portion of
<br />Homans Avenue to be abandoned.
