• 1
(7) Other public improvements shall be required as per City
Subdivision Improvement Standards.
5. Since abandonment proceedings require a considerable period of time,
we have been requested to and have decided to begin necessary processing
at this time. However, we have not yet received documentation showing
the petitioners •rill gain legal title to all of the abandoned area once
the abandonment is completed. Therefore, we are requiring that the
petitioners show that they have final right to ownership of the few
square feet in question before the final order of abandonment of Lorenzo
Avenue is issued. We will notify the City Manager if this documentation
is not forthcoming.
6. Since there appears to be no objection to the proposed vacation with the
public retention of a public utility easement, I recommend that that
portion of Lorenzo Avenue defined by City of San Leandro Legal Description
79-16 be vacated:
"EXCEPTING AND RESERVING THEREFROM, pursuant to the provisions of
Section 8330 of the Streets and Highways Code, the permanent ease-
ment and right at any tii,ie or from time to time, to construct,
maintain, operate, replace, remove, and renew sanitary sewers, and
storm drains and appurtenant structures in, upon, over and across
any street or part thereof proposed to be vacated and to construct,
maintain, operate, replace, remove, renew and enlarge lines of
pipe, conduits, cables, wires, poles and other convenient
structures, equipment and fixtures for the operation of gas pipe
lines, telegraphic and telephone lines, for the transportation or
distribution of electric energy, and for the transportation or dis-
tribution of water, including access and the right to keep the
property free from inflammable materials, and wood growth, and
otherwise protect the same from all hazards, in, upon and over the
portion of Lorenzo Avenue to be vacated."
7..
