1007 <br />IN THE CITY COUNCIL OF TPE CITY OF SAN LEANDRO <br />ORDINANCE NO. 77 - 1 <br />AN ORDINANCE VACATING A PORTION OF FOMANS AVENUE <br />Recitals <br />The City Council of the City of San Leandro on November 22, 1976, passed <br />its Resolution of Intention No. 76-392 to vacate a portion of Homans Avenue, a pub- <br />lic street in the City of San Leandro, as hereinafter described. <br />A public hearing was set for December 20, 1976, at which time any person <br />objecting to Such vacation was given the opportunity to appear and show cause why <br />such vacation should not be ordered, and notice of such meeting was duly published <br />and posted. <br />Such hearing was held by the City Council on December 20, 1976, and the <br />City Council at the time of such hearing determined that said portion of Homans <br />Avenue was unnecessary for present or prospective public use. <br />NOW, THEREFORE, the City Council of the City of San Leandro does ORDAIN <br />as follows: <br />Section 1. That portion of Homans Avenue located within the City of San <br />Leandro, Alameda County, California, is unnecessary for present or prospective <br />public use and said portion of Homans Avenue is hereby vacated and abandoned. Said <br />portion of Homans Avenue is described as follows: <br />Real property in the City of San Leandro, County of Alameda, State <br />of California, being a portion of Homans Avenue, as said Avenue is <br />shown on "Map No. 1, Bellevue Park Tract," filed November 28, 1894 <br />in Map Book 17, at page 68, Alameda County Records, and being fur- <br />ther described as follows: <br />Beginning at the intersection of the northwest line of East Juana <br />Avenue with the southwest Tine of Homans Avenue, as said Avenues <br />are shown on the said map of the Bellevue Tract; thence northwest- <br />erly along the last said line 100 feet; thence northeasterly, at <br />right angles, 20 feet; thence southeasterly, at right angles, 100 <br />feet to the northeasterly prolongation of the said northwest line <br />of East Juana Avenue; thence southwesterly along the last said line, <br />20 feet, to the BEGINNING. <br />The above described parcel of land contains 2,000 square feet, more <br />or less; <br />reserving and excepting therefrom an easement and right in and for the benefit <br />of the City of San Leandro and any public or private utility having an interest <br />
