MEMO <br />TO: Dick Randall, Assistant City Manager <br />FROM: James ?Y'eSharrv, Chief Assistant City Attorney <br />DATE: Jan!iary 9, 1979 <br />RF: Inhabited Annexation <br />The steps involved in an inhabited annexation, such as that proposed for the <br />area between 150th Avenue and Plaza Drive, are as follows: <br />1. City Council adopts a Resolution of Application. <br />?. LAFCO holds a hearing within 90 days after Executive Officer accepts <br />Resolution of Application for filing. The hearing may be continued for <br />a maximum of 70 days. <br />3. Within 35 days after close of the hearing, LAFCO adopts a Resolution <br />Making Determinations: <br />(a) disapproving; or <br />(b) approving and designating the City as the conducting authority. <br />4. Interested parties have 60 days to request of LAFCO a change of any <br />kind in the proceedings. <br />5. Within 35 days after LAFCO adopts its Resolution Making Determina- <br />tions, City Council adopts Resolution Initiating Proceedings, setting <br />hearing for 30-45 days thereafter. The hearing may be continued for a <br />maximum of 60 days. <br />6. Within 30 days after close of the hearing, the 171ty Council adopts a <br />resolution finding the value of written protests and: <br />(a) terminating proceedings if 50% or more of registered voters in <br />territory protest; <br />(b) ordering the territory annexed subject to election therein if 25% <br />or more of registered voters or 25% or more of the owners of <br />land who owns 25% or more of the assessed value of land protest; <br />(c) ordering the territory annexed without election if neither of the <br />above applies. <br />
