Honorable Commissioners of the <br />Local Agency Formation Commission <br />January 5, 1978 <br />Page 2 <br />that all of the applicable criteria have been met, and documentation be in suf- <br />ficient detail to make a persuasive case. <br />Other required information is a "plan for providing municipal services" which is <br />mandated in MORGA. The State law requires the following be submitted by the <br />applicant: <br />Enumeration and description of services which will be extended <br />to the affected territory, including timetable. <br />• Level and range of such services. <br />• Feasibility of extending such services. <br />• Improvement requirements imposed by annexing city. <br />• Financing plans for these services. <br />• Any other data requested by LAFCo. <br />This and other relevant information should be developed by the city in sufficient <br />detail to enable the Commission to determine the city's cabability to provide ser- <br />vices in a timely, financially feasible manner. In fact, the -more "controversial" <br />the proposal, the broader the case for annexation should be. <br />Another proposal policy is that the territory be pre -zoned, unless the city can <br />make a good case why it is not appropriate at this time. This requirement forces <br />the city to be specific regarding land use and also requires the city to be the <br />"lead agency" for environmental assessment proceedings. <br />A last minimum requirement is evidence that the city has had adequate communication <br />with the residents and landowners in the territory prior to LAFCo consideration to <br />assure full understanding of the proposal. In fact, a public hearing by the appli- <br />cant or affected city would be advisable. At a minimum, the details and rationale <br />for the annexation should be adequately explained to the affected parties prior <br />to LAFCo consideration. <br />In summary, following are the recommended interim and preliminary policies/pro- <br />cedures for the island annexation law: <br />o Submittal of adequate justification and rationale for the Commission <br />to make the required findings, including the "plan for services." <br />a Pre -zoning of the territory. <br />• Sufficient meetings and/or communications in advance of LAFCo <br />consideration with the affected residents and owners to assure full <br />knowledge of the proposal. <br />
