presently planned then this Agreement shall terminate upon said annexation <br />becoming final and no payments shall accrue hereunder. If, however, annexa- <br />tion is not completed until after such payments accrue, they shall continue <br />hereunder until equivalent City taxes become payable by the Owner. <br />Said service charges shall be computed by applying the then current <br />City tax rate to the valuation of all Owner's property herein involved as <br />shown on the assessment rolls of the County of Alameda and shall be paid at <br />the same time and manner and subject to the same penalties for delinquency <br />as City taxes upon similar property. <br />This Agreement may be terminated by either party upon July 1 of any <br />year upon at least four months' written notice to the other party; in the <br />event of such termination Owner agrees to disconnect at Owner's expense all <br />sewer and other lines by which any municipal service shall have been pro- <br />vided, and agrees to save the City harmless for discontinuance of any or all <br />municipal servicing rendered hereunder. <br />In Witness Whereof, Owner has signed this Agreement and the City has <br />caused its name to be signed and its official seal to be affixed by its <br />officers thereunto duly authorized this 2d day of March, 1959. <br />CITY OF SAN LEANDRO <br />BY <br />Jack D.
