AGREEMENT <br />This Agreement, made and entered into by and between the City of San <br />Leandro, a municipal corporation, hereinafter called the City, and <br />Mary Joseph Cunha, formerly Mary Joseph,hereinafter called the Owner. - <br />Whereas, the Owner is desirous of having certain uninhabited territory <br />owned by her and located on Davis Street near the intersection thereof with <br />Doolittle Drive and surrounded by the City of San Leandro, a particular de- <br />scription of which said property is marked Exhibit "A," attached hereto and <br />by this reference incorporated herein, annexed to said City and to receive <br />the benefits and services rendered by such City; and <br />Whereas, such annexation may take some time to complete; and <br />Whereas, the Owner is desirous of receiving the services and benefits <br />of being annexed to and becoming a part of the City at the earliest possible <br />date: <br />Now, therefore, this Agreement witnesseth.- <br />That in consideration of the premises and of the promises on the part <br />of the Owner hereinafter contained the City grants to the Owner a personal <br />license (not running with the land) to connect its plant to the sewer line <br />of the City immediately and the City further agrees to extend all municipal <br />services to the Owner that can be legally rendered, including but not limited <br />to, fire protection and domestic and industrial sewage services as fully as <br />though said land was actually within the corporate limits of the City. <br />In consideration of such services, the Owner promises and agrees that <br />if through any reason said annexation is not completed that the Owner will <br />pay to the City at the time hereinafter set forth an annual service charge <br />for the foregoing municipal services which charge shall be equal to all real <br />and personal property taxes upon all the property of the Owner were it lo- <br />cated in the City, for all municipal purposes including its proper pro rata <br />of all existing outstanding bonded indebtedness of the City of San Leandro <br />and of any future bonded indebtedness that may be voted while this Agree- <br />ment is in effect. Said service charge shall commence July 1, 1960, and <br />continue thereafter until said service charge is replaced by taxes upon said <br />property through and after annexation to the City of San Leandro.
