d4-1601, <br />PRELIMINARY PROCEEDINGS <br />1. Initiation of-%eorganization <br />A. By petition <br />1. Stating information like names, nature of proposed <br />change, etc. <br />2. Signed by not less than (5% of the resident voters or <br />landowners in area proposed to be detached) (5% of the <br />landowners owning 5% of the assessed value of the land <br />to be detached) <br />3. In either case filing and certification is required (with <br />County Clerk) . <br />B. By application of the legislative body (Council) <br />1. By adoption of a resolution containing requisite information. <br />2. The resolution is filed with LAFCO's executive officer. <br />A <br />3. The executive officer must set a hearing (notice required) <br />II. Notide and Hearings before LAFCO <br />A. Power: LAFCO has the power to approve or disapprove in whole or <br />in part or conditionally any changes in organization. <br />1. They must consider the City's general plan in making the <br />decision. <br />2. They may determine where an election is called whether the <br />whole district or the detaching part shall vote. <br />B. Notice and Hearing. <br />1. Mandatory without consent of 100% of the landowners in <br />writing or proof of same(If given, it is also possible to <br />avoid an election). <br />2. A date is set upon filing of the petition or application <br />and notice by publication and mail. <br />3. The hearing shall be within 70 days of filing. <br />III. Resolution by LAFCO <br />A. They shall approve or disapprove within 35 days of the hearing <br />by resolution. <br />
