Immediately upon receipt of your <br />first letter, dated March 29, 1972, we contacted the <br />Eden Township Hospital District to determine whether <br />or not beneficial use of this property by a private <br />individual constituted, within the meaning of the <br />107 series of the Revenue and Tax Code, a taxable <br />possessory interest. Upon being informed of the <br />terms of its use, we requested the advice of the <br />County Counsel's office as to whether or not Rule <br />28B, Title 18 of the California Administrative Code' <br />would be applicable in this situation. At length <br />we were advised by County Counsel that a taxable <br />possessory interest probably does exist. Accord- <br />ingly, we are making an assessment for possessory <br />interest at this location beginning with the <br />1972-73 assessment roll. <br />If you have further questions regarding. <br />the amount of assessment or resulting tax amounts, <br />we suggest that you contact the County Tax Collector <br />after July 1, 1972. <br />CHM:mb <br />Yours very truly, <br />DON J.
