The dwelling you note in your letter of <br />March 29, 1972 has situs.on parcel 84A-172-4-4, owned <br />in fee by the Hospital District. <br />There is provision in law under the 107 series <br />of the Revenue and Taxation Code for the assessment of <br />the possessory interest of a private individual who has <br />the beneficial use of publicly owned land and/or improve- <br />ments. <br />Eden Township Hospital District, which provides us <br />with a tenancy list (from which, for example, the <br />possessory interest assessments are made for the privately <br />run pathology and x-ray facilities on site), has never <br />shown such beneficial use by a private individual of a <br />single family dwelling at 20103 Lake Chabot Road. <br />Yours very truly, <br />DON J.
