a <br />7' <br />:XZ <br />The Boundary Commission -further reported that Assessor's parcel number <br />79A-422-3-1 would be split, and recommended that the proponenticonsider <br />inclusion of sat assessment parcel in its entirety, together with a <br />state -assessed parcel which is assessed to the Southern Pacific Company. <br />GENERAL C0P!MENTS <br />The Standing Rules of Commission provide that if a proposal -hows a <br />corridor, or, if the proposal results in the splitting of an assessment par- <br />cel, t':� proponent must just--'y such proposal. The proponent city was appar- <br />ently __-.;,--re that an assessment parcel split would occur. <br />A problem with this proposal is that the rules of the Commission do not <br />specifics,i--y cover a situation of this unusual sort, where the area in ques- <br />tion is al --early a-_ unincorporated island entirely surrounded by a city. <br />Approval of the __oposal would reduce the size of the island, but would not <br />eliminate it. <br />If the territory of `.`_e proposal were annexed, the strip and t'_e remainder of <br />the r, cel would still be an island within the East Bay Municipal Utility <br />District. That district could annex such areas under its provisions with a <br />"deferred" annexation charge, if, in fact, water service is not required in <br />the excluded parcel. <br />RECOMM—DATION <br />Based upon review of the proposal, it would appear to be in the interests of <br />t.e City of San Leandro, and of the more orderly growth and development of <br />the area if the entire island were annexed at one time, and that it also be <br />included within the East Bay Municipal Utility Distiict. <br />THMEFORE, IT IS RECO2•=NDED : <br />That approval of annexation be subject to the following modifications <br />and conditions: <br />6/21/65 <br />1. That the map and description be corrected as <br />recommended by the Boundary Commission in its <br />report No. 886; <br />2. That the proposal be modified to include all of <br />Assessment Parcel No. 79A-422-3-1 and State - <br />assessed parcel No. 872-1-117C, Parcel 15. <br />3.
