Exhibit A, attached hereto and made a part hereof; and Whereas, approximately one-half of the property owners of that unannexed remainder of the District have expressed a desire to annex to the City of San Leandro; and Whereas, the District intends to cease to exist on March 11, 1958 by not filing the affidavit pursuant to 3�14017 and 14o18 of the Health and Safety Code of the State of California; and Whereas, the total assets, including unapportioned taxes for 1957-581,are approximately $102,000.00; and Whereas, the assessed value of the area withdrawn as afore- said is 97.06% of the total assessed value of the District; and Whereas, pursuant to the provisions of §14255.1 of the Health and Safety Code, the City shall be entitled to approximately $99,002.00 in assets of the District; and Whereas, after distribution of the District's assets, the District could not provide adequate fire protection to that portion of the District remaining; and Whereas, City has the nearest fire protection available to that portion of the District remaining and is wholly capable of pro- viding adequate fire protection to that portion of the District re- maining. Now, therefore, it is mutually agreed as follows: 1. That on January 1, 1958, or as soon thereafter as possible, District shall convey, deliver and transfer to City all of its assets of which a partial inventory has been made and attached hereto as a part hereof as Exhibit B, with the exception of a. Unapportioned taxes due the District, which shall be transmitted to the City by the County of Alameda on or before July 1, 1958, and b.
