Exhibit A, attached hereto and made a part hereof; and <br />Whereas, approximately one-half of the property owners of that <br />unannexed remainder of the District have expressed a desire to annex to <br />the City of San Leandro; and <br />Whereas, the District intends to cease to exist on March 11, <br />1958 by not filing the affidavit pursuant to 3�14017 and 14o18 of the <br />Health and Safety Code of the State of California; and <br />Whereas, the total assets, including unapportioned taxes for <br />1957-581,are approximately $102,000.00; and <br />Whereas, the assessed value of the area withdrawn as afore- <br />said is 97.06% of the total assessed value of the District; and <br />Whereas, pursuant to the provisions of §14255.1 of the Health <br />and Safety Code, the City shall be entitled to approximately $99,002.00 <br />in assets of the District; and <br />Whereas, after distribution of the District's assets, the <br />District could not provide adequate fire protection to that portion of <br />the District remaining; and <br />Whereas, City has the nearest fire protection available to <br />that portion of the District remaining and is wholly capable of pro- <br />viding adequate fire protection to that portion of the District re- <br />maining. <br />Now, therefore, it is mutually agreed as follows: <br />1. That on January 1, 1958, or as soon thereafter as possible, <br />District shall convey, deliver and transfer to City all of its assets of <br />which a partial inventory has been made and attached hereto as a part <br />hereof as Exhibit B, with the exception of <br />a. Unapportioned taxes due the District, which shall <br />be transmitted to the City by the County of Alameda on or before July 1, <br />1958, and <br />b. The approximate sum of $2,998.00 in cash, which is <br />the District's 2.94% share of assets to be retained, and which shall be <br />- 2.- <br />
