IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 65 - 299 <br />RESOLUTION OF INTENTION TO WITHDRAW ANNEXED <br />TERRITORY FROM ASHLAND COUNTY FIRE PROTECTION <br />DISTRICT <br />(Nimitz Freeway Annexation) <br />Recitals <br />By Resolution No. 65-120, adopted May 17, 1965, the City of San <br />Leandro requested the Board of Supervisors of Alameda County to annex <br />to the City of San Leandro all unincorporated portions of the Nimitz <br />Freeway bounded on both sides by the City of San Leandro. <br />By its Resolution No. 113633 the Alameda County Board of Supervisors <br />filed a notice of intention to annex said territory to the City of San <br />Leandro, and the proposal for annexation has been submitted to the Local <br />Agency Formation Commission for review. <br />There is included within said territory proposed to be annexed cer- <br />tain State assessed properties with assessed valuation of $31,400, of which <br />valuation $27,800 is contained within the Ashland County Fire Protection <br />District. <br />Upon completion of annexation of said territory, that portion of the <br />territory within the Ashland County Fire Protection District would be sub- <br />ject to taxation by the City and said District. <br />Section 14540 of the Health and Safety Code provides that upon com- <br />pletion of the annexation proceedings the City may provide by resolution <br />for the withdrawal of such territory from the District. <br />Now, therefore, the City Council of the City of San Leandro does <br />RESOLVE as follows: <br />That it is the intention of this City Council to take the necessary <br />and proper steps upon completion of the Nimitz Freeway Annexation to with- <br />draw from the Ashland County Fire Protection District that portion of the <br />annexed territory which now lies within said District. <br />
