AGREEMENT This Agreement entered into this / I I t day of 10S 964, by and between the City of San Leandro, a municipal corporation, hereinafter called "City", and Oakland Scavenger Company, a California corporation, hereinafter called "Company", Recitals: The City of San Leandro is presently negotiating an amendment to an existing agreement between the City and the Port of Oakland in which agreement the City is granted certain rights to dispose of garbage on Port of Oakland property; Such proposed amendment requires the acquisition by the City of San Leandro of an equivalent area for the dumping of garbage; Oakland Scavenger Company has signified its intent to make an adequate area available to the City of San Leandro for such dumping of garbage; It would be of mutual benefit to both City and Company to enter into an agreement concerning disposal of garbage by the City on property owned by Company; Now, therefore, in consideration of the mutual promises herein- after contained, the parties hereto do agree as follows: Company agrees to dispose of all the garbage and other refuse, collected by City and delivered to the Davis Street dumping area pres- ently owned by Company. City agrees to pay to Company the sum of One and 50/100 Dollars ($1.50) per ton for all garbage and other refuse so disposed of by Company, provided, however that the maximum annual cost to the City for all garbage and other refuse so disposed of shall be the sum of Four- teen Thousand Four Hundred Dollars, ($14,400).
