Company agrees to pay to City the sum of Forty Cents (40�) per <br />cubic yard for all clean earth materials derived from City projects <br />delivered to the Davis Street site of Company, and for such material <br />that the City may leave when it vacates its existing dump sites. <br />IV <br />A check on weights of garbage delivered shall be made by Company <br />on Company's scales at quarterly intervals or oftener. Each such weight <br />check shall be of a duration as determined by Company. <br />n <br />City agrees that if there is an increase of five per cent (5%) or <br />more in tonnage of materials delivered by City for disposal by Company <br />resulting from annexations to existing service area, or a change in type <br />of service by City, the maximum annual payment by City as set forth in <br />Paragraph II hereof shall be increased in proportion to such increase <br />in volume.
