10/15/46 iU-! eaQ <br />A G f E E M F N T <br />THIS AGREEMENT made and entered into this 18th <br />day of October , 19480 by and between the CITY OF <br />OAKLAND, acting by and through its Board of Port Commissioners, <br />and the CITY OF SAN LEANDRO, both municipal corporations, <br />organized and existing under the laws of the State of Calif- <br />ornia, <br />W I T N E S S E T H: <br />WHEREAS, both cities have requirements in the use <br />of the tideland lots south and east of Oakland Municipal Air- <br />port, one for the purpose of the establishment of an outfall <br />from its sewage disposal plant and the other for the exten- <br />sion of runways and the protection of the approaches thereof <br />at the Airport; and <br />WHEREAS, it has been determined that the needs <br />of the two cities are compatible and in their mutual inter- <br />est; now, therefore, this <br />AGREEMENT: <br />FIRST: The City of Oakland hereby agrees to <br />. <br />amend its complaint and to acquire by eminent domain pro- <br />ceedings the privately owned tideland lots lying northerly <br />and westerly of a line drawn between the southerly line of <br />Davis Street being the southerly corner,of Section 33, and <br />11 <br />the southwest corner of Lot 240 Section 4, <br />SECOND: All references are to sections desig- <br />nated on that certain map entitled "Map No. 2 of Salt Marsh <br />and Tidelands, situate in the County of Alameda, State of <br />California" on file in the office of the Department of Finance, <br />-1" <br />
