State Lands Commission (formerly the office of the Surveyor <br />General) of the State'of California, and on "Sale Map No. 10 <br />of Salt Marsh and Tide Lands, situate in the County of Ala- <br />meda, State of California," filed June 9, 1888, in Book 17 <br />of Maps at page 30, in the office of the County Recorder of <br />Alameda County. <br />THIRD: The City of Oakland agrees to convey to <br />the City of San Leandro for the considerations in this agree- <br />ment contained, a strip of land, abutting upon and immediately <br />adjacent to the line described in the preceding paragraph <br />between the mentioned points of Davis Street and Lot 24, two <br />hundred (200) feet wide and extending between the termini <br />mentioned. It is a condition that the lands so to be con- <br />veyed are to be used for an outfall for a sewer and that no <br />fill or permanent structure shall be placed on such land <br />which shall exceed in altitude twenty-three (23) feet above <br />mean lower low water, or which shall exceed the glide angle <br />prescribed by competent authority affecting the runways at <br />Oakland Municipal Airport. <br />The City of Oakland agrees to obtain an order <br />for possession of said strip immediately and deliver poses- <br />sion thereof to the City of San Leandro immediately thereafter. <br />FOURTH: The City of Oal-land hereby agrees to <br />convey to the City of San Leandro Lots 14 and 15 in Section <br />33 for municipal purposes, with the primary understanding <br />that the City of Oakland is acquiring these parcels for the <br />purpose of protecting the approaches to Oakland Municipal <br />Airport.
