5/6/64 <br />To City Council: <br />The annexation of Eden Road Properties is being accom- <br />plished by resolution, rather than ordinance. We have here- <br />tofore zoned newly annexed property by the same ordinance <br />which annexed it to the City. We cannot legally zone property <br />by resolution. Therefore, I am proposing to zone Eden Road <br />Properties by the attached emergency interim zoning ordinance <br />so that we will have complete control of the zoning in this <br />area from the day of annexation. <br />I strongly recommend that planning studies be made at <br />the earliest possible date to determine proper zoning of this <br />area. There is little doubt that it is industrial, but regular <br />proceedings should be taken to so determine. The last ordinance <br />of this type that I recall being adopted was the interim zoning <br />of Foothill Manor in the Halcyon area. It required from two to <br />three years to affect permanent zoning. In my opinion, this is <br />an unreasonable length of time. The Zoning Ordinance would <br />probably have fallen had it been attacked in the latter part <br />of this period. <br />Arthur M. Carden <br />City Attorney <br />
