IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2022- RESOLUTION TO APPROVE AND AUTHORIZE THE CITY MANAGER TO EXECUTE A NON-PROFESSIONAL SERVICES AGREEMENT WITH GARLAND/DBS, INC. FOR ROOF RESTORATION PROJECTS FOR FISCAL YEAR 2022-2023 FOR $536,362 AND TO NEGOTIATE AND APPROVE CUMULATIVE CHANGE ORDERS UP TO 10% OR $53,636 OF THE ORIGINAL CONTRACT AMOUNT WHEREAS, a draft agreement between the City of San Leandro and Garland/DBS, Inc. was presented to this City Council; and WHEREAS, the City Council is familiar with the contents thereof; and WHEREAS, Change Orders of up to 10% to modify bid quantities or to respond to unexpected conditions are a normal aspect of public contracting and construction; and WHEREAS, to deliver high quality public works projects on schedule and within budget, the Council finds that authorizing the approval of Change Orders is in the best interest of public health, safety, and welfare; and NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: 1. That said agreement of $536,362 with Garland/DBS, Inc. substantially in the form presented is hereby approved and execution by the City Manager is hereby authorized; and 2. That the City Manager is authorized to make non-substantial revisions to said agreement, subject to approval as to form by the City Attorney; and 3. That the City Manager or her designee is authorized to negotiate and approve cumulative change orders up to a maximum of 10%, which is $53,636 of the original contract amount; and 4. That an original executed agreement shall be attached to and made a part of this resolution.
