Amendment No. 3 to Consulting Services Agreement between City of San Leandro and Kleinfelder 12/7/2022 for Manor Park Irrigation Well Replacement Page 1 of 4 AMENDMENT NO. 3 TO CONSULTING SERVICES AGREEMENT BETWEEN THE CITY OF SAN LEANDRO AND KLEINFELDER, INC. FOR MANOR PARK IRRIGATION WELL This Amendment No.3 (“Amendment”) is made by and between the City of San Leandro (“City”) and Kleinfelder, Inc. (“Consultant”) (together sometimes referred to as the “Parties”) as of ______________, 2022 and amends that certain Consulting Services Agreement (“Agreement”) dated March 15, 2019 between the Parties. WHEREAS, City and Consultant have executed the Agreement, pursuant to which Consultant has provided certain consulting services to City with regard to Family Aquatics Center Competition Pool (Well Replacement), and WHEREAS, the Parties desire to amend the Agreement to include additional design services, field inspection, and construction administration activities. NOW THEREFORE, for good and valuable consideration, the sufficiency of which is hereby acknowledged, the Parties hereby agree to amend the Agreement as follows: 1. Section 1.1 of the Agreement entitled “Term of Services” is hereby amended to extend the term from December 31, 2021 to December 31, 2023; and 2. Section 2 of the Agreement entitled “Compensation” is hereby amended to pay Consultant a sum not to exceed ONE HUNDRED THOUSAND NINE HUNDRED FORTY ONE AND NO/ DOLLARS ($100,941); and 3. Exhibit A of the Agreement entitled “Scope of Services” is hereby amended to add the following text at the end of the section: Add the following paragraph at the end of the section for both Task 1: Well Plans and Specifications and Task 2: MEP Plans and Specifications: • Meet with City Staff to review comments and confirm revisions to be incorporated into the last progress PS&E submittal from September 2021. • Revise plans to include all items needed for a complete and functional irrigation well that can provide makeup water to the parks’ existing irrigation system. • Bid items that will vary based on actual field conditions or by manufacturer / owner options, shall be defined with performance specifications in sufficient detail as to allow inclusion in the contractor bid as a deferred submittal.
