<br /> <br /> <br />Non-Professional Services Agreement between January 3, 2023 <br />City of San Leandro and Newton Construction & Management, Inc.—Exhibit A Page 5 of 5 <br />Adequate warning devices, barricades, guards, flagger or other necessary precautions shall be taken by <br />the contractor to give advised and reasonable protection, safety and warning to persons and vehicular <br />traffic concerned in the area. Construction signs, lights, barricades, etc., shall conform to the latest <br />revision of the Manual of Warning Signs, Lights and Devices for Use in Performance of Work Upon <br />Highways, by California Department of Transportation. <br />Contractor is required to submit a Traffic Control Plan and obtain an encroachment permit prior to <br />commencing work. Contact the Engineering and Transportation Department at 510-577-3428 for <br />assistance. <br />UNKNOWN OBSTRUCTIONS: Should any unknown obstruction be encountered during their contract the <br />Contractor immediately bring it to the attention of the City. The contractor shall be responsible for the <br />protection of all existing equipment, furniture, or utilities encountered within the work area. <br />WEEKLY MEETINGS: Contractor shall be required to meet weekly with the project supervisor or his <br />representative to confirm the work completed, discuss any issues that may have occurred, and to review <br />the contractor’s proposed work schedule. <br />WAGES: This contract requires the payment of prevailing wages for the State of California or the City <br />of San Leandro Living Wage whichever is higher. Additional provisions are outlined in Exhibit D of the <br />Non-Professional Services Agreement. <br />WARRANTY: The Contractor guarantees all work for one year from the date of project completion. Upon <br />receiving written notice of a need for repairs that are directly attributable to defective materials or <br />workmanship, the Contractor must make good any defects arising or discovered in any part of the work <br />by diligently commencing the necessary repairs within seven (7) days from the date of notice from the <br />City. The guarantee and conditions shall be secured by a Warranty Letter. <br />If the Contractor fails to make good any defects in the work in accordance with this provision, in addition <br />to any other available remedy under the contract or at law or equity, the City may make good or have <br />made good such defects in the work and deduct the cost from amounts that may be due or become due <br />the Contractor. <br />In addition to the Contractor’s one-year guarantee, the Contractor must provide all written manufacturer <br />warranties from manufacturers and/or subcontractors that guarantee and warrant specific products and <br />installations against defects in materials and workmanship for periods following acceptance of the project. <br />WASTE & RECYCLING: During performance and upon completion of work on their project contractor will <br />remove all unused equipment and instruments of service, all excess or unsuitable material, trash, rubbish <br />and debris, and legally dispose of same, unless otherwise directed by these specifications. Contractor <br />shall leave entire area in a neat, clean and acceptable condition as approved by the City. <br />Contractor is required to use the City’s franchised waste hauler, Alameda County Industries, for all on-site <br />debris box and hauling services unless the Contractor self-hauls waste to a licensed and permitted <br />recycling facility, transfer facility or landfill. To order debris box services contact ACI at 510-357-7282. <br />Contractor shall demonstrate compliance with state and local construction & demolition recycling <br />regulations by completing and submitting a Diversion Plan online with Green Halo Systems <br />(www.greenhalosystems.com).Contractor shall create an account with Green Halo and enter project <br />information within 30 days of purchase order issuance.
