B. Permitted Use. This Administrative Site Plan Review conditional approval allows <br />building upgrades and site improvements, including, but not limited to raising the <br />roof on the existing building, removing loading dock doors, removing a northern <br />portion of the building, repaving the parking lot and vacant areas, and installing <br />landscaping and accessible walkways. The subject property is 2002 Davis St, also <br />known as Alameda County Assessor's Parcel Number 079A-0417-001-18. <br />C. Expiration. Pursuant to Zoning Code Section 2.04.408(J), this approval shall lapse <br />on Friday, August 30, 2024 unless a) there is diligent progress evidencing a good <br />faith intent to commence the intended use, or b) an occupancy permit has been <br />issued, or c) a written request for a one-year extension of the approval is approved <br />by the Zoning Enforcement Official. <br />D. Succession. The Applicant and/or Property Owner shall be responsible for assuring <br />that any successor in interest who assumes responsibility for this zoning approval <br />is informed of its terms and conditions. <br />E. Amendments. Construction of the project shall remain in substantial compliance <br />with the approved exhibits and plans. Modifications to the approved Conditions of <br />Approval and Plan Exhibits, may require resubmittal of a revised Site Plan Review <br />application in accord with Zoning Code Section 5.12.132(C) (Changed Plans).No <br />application for amendment of the application or Conditions of Approval may be <br />accepted or submitted for processing by the City unless (i) there is full compliance <br />with all terms of the application and Conditions of Approval; or (ii) the Community <br />Development Director waives compliance with the terms of the application and <br />Conditions of Approval pending application for the amendment. <br />II. REQUIRED ON -SITE IMPROVEMENTS <br />A. MWELO Certificate of Completion. Prior to building/grading permit final, the <br />Applicant/Property Owner shall submit a Certificate of Completion, as defined in <br />the State Model Water Efficient Landscape Ordinance (MWELO), to the Zoning <br />Enforcement Official for review and approval. All required landscaping and <br />irrigation shall be installed per the approved final landscape and irrigation plan, <br />with respect to size, number, and species of plants, and provision of adequate <br />irrigation coverage. The Certificate of Completion shall include, but is not limited <br />to, certification that the landscape project has been installed per the approved plans, <br />pursuant to MWELO. <br />B. Fences and Gates. Prior to building/grading permit final, all new and remaining <br />fences shall be compliant with Zoning Code Section 4.04.364, which requires in <br />part that "fences that are adjacent to the required minimum front, corner side and/or <br />rear yard with frontage along a public street frontage shall be constructed of either: <br />(a) tubular steel, or of equally high quality "visually transparent" style; or (b) a solid <br />architectural wall compatible with the building colors and materials".
