WHEREAS, since 2020, the Shoreline Advisory Group has been provided updates and invited to public <br />meetings on the project and Shoreline park; and <br />WHEREAS, the City of San Leandro and Cal Coast Companies LLC, Inc. entered into a Disposition and <br />Development Agreement with respect to certain City owned property located within the Shoreline <br />development area of the City, dated as of July 22, 2020, as amended by the First Amendment to Purchase and <br />Sale Agreement and Disposition and Development Agreement dated as of March 17, 2021 and the Second <br />Amendment dated as of June 21, 2022 and Third Amendment dated as of December 19, 2022 (as amended, <br />the "DDA"); and <br />WHEREAS, Cal Coast desires to develop a portion of the Shoreline development area with a multi - <br />component development that includes the construction of approximately 206 detached single-family homes <br />and attached townhomes; the redesign and reconstruction of an existing 9-hole golf course; the construction <br />of a hotel with 210 rooms, publicly accessible outdoor space, and a restaurant; the construction of a market - <br />rate multifamily residential development with 285 rental units; the construction of a restaurant and banquet <br />facility; and the construction of a single -story freestanding building shell to house a market or other <br />neighborhood serving retail or service facility; and <br />WHEREAS, in connection with Cal Coast's development of a portion of the Shoreline development <br />area, the City desires to design and construct an approximately eight acre park, demolish certain <br />improvements in the San Leandro Marina Harbor, reconstruct the Mulford -Marina Branch Library, and <br />undertake other public improvements within and adjacent to the Property; and <br />WHEREAS, the Group's input has informed and shaped the development of the final scope of the <br />project, the scope of which was finalized as a part of the DDA, EIR Addendum and associated entitlements <br />approved on February 24, 2020 and Development Agreement, DDA Amendment, EIR Addendum and planning <br />entitlements on June 21, 2022; and <br />WHEREAS, the group's input was solicited at a series of public meetings for the Shoreline Park, <br />including in 2017 and 2022, which design has been refined and submitted to the Design Review Committee of <br />the Bay Coastal Design Commission (BCDC); and <br />WHEREAS, the sale and leasing of certain properties for private development by Cal Coast <br />Development LLC, Inc. was finalized prior to December 31, 2022; and <br />WHEREAS, Cal Coast Development intends to proceed to prepare for construction of the Shoreline <br />Development project in line with the approved entitlements and agreements, and the City of San Leandro <br />intend's to proceed to finalize plans and prepare for construction of the Shoreline Park, incorporating the <br />community's input; and <br />WHEREAS, the City finds that the Shoreline Advisory Group has completed their charge to assist in <br />refining the plans and studies for the Shoreline Development Project and Shoreline Park and such plans are <br />now proceeding towards development; and <br />
