City of San Leandro <br />City Council <br />Meeting Date: February 6, 2023 <br />Agenda Number: 13.a. <br />Agenda Section: ACTION ITEMS <br />File Number: 23-009 <br />File Type: Staff Report <br />Adopt a Resolution to Approve an Exception to the 180-Day Waiting Period for Post-Retirement <br />Employment Pursuant to Government Code Section 7522.56 for Sandra Colwell <br />COUNCIL PRIORITY <br />•Public Safety <br />•Infrastructure <br />SUMMARY <br />The Police Department has a critical vacancy in the Records Divisions. <br />RECOMMENDATIONS <br />Staff recommends that the City Council adopt a resolution for an exception to the 180-day waiting <br />period per Government Code §7522.56 for temporary employment of retired annuitant Sandra <br />Colwell certifying that the nature of employment and appointment is necessary to fill a critically <br />needed position before 180 days have passed following the date of retirement. <br />BACKGROUND <br />Government Code §7522.56(f) requires a 180-day waiting period before a retiree can return to <br />work for a CalPERS employer without reinstating from retirement, except under certain specified <br />circumstances. An exception to the 180-day waiting period is permitted by law if the City Council <br />presents CalPERS with a resolution that approves the appointment in which the employer has <br />certified the nature of the employment and that the appointment is necessary to fill a critically <br />needed position before 180 days have passed. The appointment must be passed in a public <br />meeting and may not be placed on the consent calendar. <br />Analysis <br />Sandra Colwell was employed as a Records Clerk and worked in the Police Department for 14 <br />years until her retirement on December 29, 2022. The Police Department is requesting approval <br />to re-hire Sandra Colwell as an extra help retired annuitant for a limited duration to support the <br />Records Division. <br />For the last 10 years, Ms. Colwell has been assigned to the Professional Standards and Training <br />Unit as the training coordinator. The training coordinator position is responsible for managing <br />and maintaining all training records for the Police Department, which ensures the department is in <br />compliance with the State of California Commission on Peace Officer Standards and Training’s <br />Page 1 City of San Leandro Printed on 2/2/2023
