Owner is responsible for having work areas clear of all material, equipment, furniture, <br />appliances, fixtures, etc. prior to mobilization and during work. <br />7. Bid subject to buildings and work areas being clear and accessible to personnel, material, and <br />equipment for the entire length of work. <br />8. Owner expressly acknowledges that Contractor is a licensed contractor authorized to perform <br />work provided in this Contract and that the Contractor is not an engineer or a design consultant. <br />Proposals made by Contractor with respect to work to be performed are made solely for the <br />consideration of Owner and Owner’s design engineer or design consultant, who shall be solely <br />responsible for determining whether any such work proposed by Contractor is, or will be, <br />adequate to satisfy the needs and or purposes of the Owner. Except as expressly provided in this <br />Contract, no warranty or representation of any kind or nature with respect to any such proposal. <br />Warranty with respect to fitness for any purpose or use is expressly disclaimed to the fullest <br />extent of the law. <br /> <br /> <br />Exclusions: <br /> <br />1. Building Design, Engineering, and Permitting <br />2. Signage, eyewash, wall hangers, etc. for removal and replacement/resetting <br />3. Temporary utilities (heat, power, water, lights). <br />4. This proposal specifically excludes: shop drawings; LEED certification; engineering or <br />architectural services; as-built plans; engineered survey; all permits and fees; inspection fees; <br />costs for testing, handling and/or removing any hazardous/contaminated materials; SWPP Plans, <br />monitoring or installation. <br />5.
