<br />Non-Professional Services Agreement between September 1, 2023 <br />City of San Leandro and T&S Intermodal Maintenance, Inc.—Exhibit A Page 2 of 2 <br /> <br /> <br /> <br />normal working hours 7am-4pm, Monday through Friday, unless otherwise stated above. We <br />would be happy to discuss alternatives for scheduling if other requests are needed. <br />2. Owner to provide staging area directly adjacent for work. <br />3. Owner is responsible for having work areas clear of all material, equipment, <br />furniture, appliances, fixtures, etc. prior to mobilization and during work. <br />4. Bid subject to buildings and work areas being clear and accessible to personnel, material, <br />and equipment for the entire length of work. <br />5. Owner expressly acknowledges that Contractor is a licensed contractor authorized to perform <br />work provided in this Contract and that the Contractor is not an engineer or a design <br />consultant. Proposals made by Contractor with respect to work to be performed are made <br />solely for the consideration of Owner and Owner’s design engineer or design consultant, who <br />shall be solely responsible for determining whether any such work proposed by Contractor is, <br />or will be, adequate to satisfy the needs and or purposes of the Owner. Except as expressly <br />provided in this Contract, no warranty or representation of any kind or nature with respect to <br />any such proposal. Warranty with respect to fitness for any purpose or use is expressly <br />disclaimed to the fullest extent of the law. <br /> <br />Exclusions: <br />1. Venting for microwave, or any roof penetration and waterproofing <br />2. Flooring <br />3. Repair, patching, and/or floating existing walls not damaged by water <br />4. Dishwasher and refrigerator installation (by owner) <br />5. Building Design, Engineering, and Permitting <br />6. Signage, wall hangers, etc. for removal and replacement/resetting <br />7. Temporary utilities (heat, power, water, lights). <br />8. This proposal specifically excludes: shop drawings; LEED certification; engineering or <br />architectural services; as-built plans; engineered survey; all permits and fees; inspection fees; <br />costs for testing, handling and/or removing any hazardous/contaminated materials; SWPP <br />Plans, monitoring, or installation. <br />9.
