IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2023-XXX RESOLUTION OF THE CITY OF SAN LEANDRO CITY COUNCIL TO ENTER INTO A CONSULTING SERVICES AGREEMENT WITH SCHAAF AND WHEELER FOR THE DESIGN OF STORMWATER TRASH CAPTURE DEVICES, PROJECT NO. 2017.0540 FOR $675,000.00; TO AUTHORIZE INDIVIDUAL AGREEMENT AMENDMENTS UP TO 10% (OR $67,500.00) OF THE ORIGINAL CONTRACT AMOUNT; AND TO AUTHORIZE CUMULATIVE AGREEMENT AMENDMENTS UP TO 30% (OR $202,500.00) OF THE ORIGINAL CONTRACT AMOUNT WHEREAS, this design work is necessary to meet the requirements of the San Francisco Municipal Regional Stormwater National Pollutant Discharge Elimination System Permit and the City’s Trash Load Reduction Plan filed with the Alameda County Clean Water Program; and WHEREAS, an agreement between the City of San Leandro and Schaaf and Wheeler is presented to this City Council; and WHEREAS, the City Council is familiar with the scope of work and compensation schedule for the agreement; and WHEREAS, the City Manager recommends approval of said agreement. NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: •That said agreement substantially in the form presented is hereby approved and execution by the City Manager is hereby authorized; and •That the City Manager is authorized to make non-substantial revisions to said agreement, subject to approval as to form by the City Attorney; and •That an original executed agreement shall be attached to and made a part of this resolution; and •That the City Manager or her designee is authorized to negotiate and approve individual agreement amendments to the consulting services agreement up to 10% (or $67,500.00) of the original agreement amount; and •That the City Manager or her designee is authorized to negotiate and approve agreement amendments to the consulting services agreement up to a cumulative value not to exceed 30% (or $202,500.00) of the original agreement amount.DRAFT
